Email specific SERVICE AGREEMENT
CNG Internet's Service Agreement is merely a statement of "good business practices"
and can be summarized as follows:
- use the Internet wisely - it is a powerful tool and our service gives you full
access to its capabilities
- do not use our service to do illegal things
- respect other Internet user's rights to use the Internet and to provide Internet
service
This Service Agreement represents the complete Agreement and understanding between
CNG Internet and you, the CNG Internet accountholder, and supersedes any other written
or oral agreement pertaining to your CNG Internet service. By using CNG Internet,
you agree to be bound by and to comply with this Agreement, just as if you had signed
it. Violation of any provision of this Agreement is grounds for immediate termination
of your CNG Internet account.
IF YOU DO NOT AGREE TO BE BOUND BY THIS AGREEMENT, YOU SHOULD IMMEDIATELY END YOUR
USE OF CNG INTERNET SO THAT WE MAY CANCEL YOUR ACCOUNT AND, IF APPROPRIATE, GIVE
YOU A PRORATED REFUND.

CNG Internet reserves the right to modify the Service Agreement, and/or modify the
prices of its services, as well as discontinue or change the services offered. A
notification will be made by Email when modifications are made, however, it will
be the responsibility of the accountholder to keep informed about these changes.
Your continued use of CNG Internet's services following such notification
will be deemed acceptance of the modification.
A. Use of Services

This agreement is between the subscriber, and CNG Internet You are the subscriber,
and CNG Internet hosts the e-mail and collaboration service for you.

This type of account has no minimum service term. You may cancel the service at
any time by contacting CNG Internet via postal mail or e-mail. Monthly Service is
billed at the start of each service month for the following month. Open monthly
invoices must be settled by the 15th of the open month, or CNG Internet reserves
the option that incoming e-mail will be blocked by the 16th day of the unpaid month.
CNG Internet will not refund partial monthly invoices.

Our yearly e-mail subscription offers a 10% discount. You may cancel at any time
by contacting CNG Internet via postal mail or e-mail. We will refund any unused
portion of your yearly subscription, based on the then prevailing monthly subscription
price.

The first 30 days of hosted e-mail Service are free of charge. This period will
serve as an evaluation period. Should you not cancel your e-mail account with us
by the 25th day of the free month, we will convert your account into a Month to
Month Subscription. The Free Trial excludes fees for Blackberry and other mobile
devices, which must be paid in full for the free 30 day trail period.

We have a rather high limit on mailbox storage. This does not mean that you could
not exceed the limit. Please check our current subscription fee-schedule for upgrade
prices. You must take into consideration two aspects of mail storage, including:
- mail-storage is meant to be "Online" storage, not a means to "Archive" e-mail
indefinitly
- consider the practical performance limitation you will be having with "live" e-mail
of several giga bytes
Note: Archived e-mail has some very interesting implementations, including logging,
indexing, and read-only security that "online" e-mail, by it's very nature, can
not offer.

Sending spam using CNG Internet's system is not permitted. If your domain is blocked
by other ISP's we will notify you as fast as possible. CNG Internet will not be
responsible for e-mail deemed 'SPAM' by other ISP's. It is upon YOU to have your
domain removed from any and all black-lists.
During the black-list time, we will block your outgoing mail, but allow incoming
e-mail.
Should your domain remain black-listed for a period of days, we reserve the right
to suspend or cancel your CNG Internet mail-account(s).

CNG Internet's Exchange Service is protected by certain firewalls, virus protection
software, as well as spam protection software, assuring security for the entire
CNG Network.
We offer with each e-mailbox 'additional' spam protection, that you can tailor
to your level of sensitivity to spam.

All CNG Internet Exchange Services have been implemented with several layers of
virus protection. Scanning for viruses takes place BEFORE an e-mail arrives at a
particular Exchange Store (Database). Virus infected e-mail will:
- moved to a quarantine storage if possible; and destroyed if not
- we will notify you of a quarantined e-mail if possible
- we will forward you the virus infected e-mail, sans the virus, if possible
In some cases we may have to 'silently' quash the virus infected e-mail in order
to protect all others (and you).
Even with the best of all efforts, we can not 100% protect against all virus threats
and can not be held responsible for new viruses that are not detected by our systems.
You are responsible for protecting your computers and mobile devices, and ensure
your own virus-free e-mail environment.

CNG Internet will use best efforts to provide 99.99% e-mail uptime. Uptime is calculated
per month. Once you experiences e-mail downtime CNG Internet will credit you 5%
of the monthly (or calculated monthly) fee for each 30 minutes of system downtime
over the 99.99% agreement. The calculated credit can not exceed a monthly invoice
amount. Downtime does NOT include:
- Scheduled upgrades (maintenance schedules are published at your account page inside
CCP)
- Emergency maintenance (emergence maintenance occurrences are published at your
account page inside CCP)
- General Internet congestions, i.e. you may experience slowness of e-mail usages,
but the system indeed was up.
Note: Uptime guarantees are for all of the Exchange services we offer. It DOES
NOT cover BlackBerry uptime or any other mobile device uptime.

Even with our best efforts, certain 'issues' can develop, and impact our promises
to be up and running all the time. These exceptions include, but are not limited
to:
- System Updates - CNG Internet performs routine maintenance to ensure implementation
of all current patches and bug fixes.
- Internet congestion
- Terrorist Attack
- Acts of God
- Virus/Worm/Denial of Service Attack
You specifically agree that CNG Internet cannot be held liable for failure to provide
service, delay of service, delay of service provisioning, incorrect transmission
of data, corrupted or compromised data, missing data, or anything in any way connected
to the CNG Internet service in excess of the cost of service provided. The cumulative
liability of CNG Internet to a customer shall not exceed the total monthly service
fee of the immediate prior one month of service, or one twelfth of a one year subscription.

It is the customers responsibility to keep his/her password confidential. CNG Internet
is not responsible for any data losses or security issues due to stolen or hacked
passwords. CNG Internet support does not have access to existing passwords. For
security reasons, CNG Internet support can only reset passwords.

This agreement is an extension of our Standard
Terms and Condition agreement.

B. Miscellaneous
1. This agreement will be governed by and construed in accordance
with the laws of the State of New Jersey, excluding its conflict of laws principles,
and the parties' consent to exclusive personal jurisdiction of and venue in court
of competent jurisdiction located in Essex County, New Jersey.
2. Section A.1 and your obligation to pay amounts due under
this Agreement will survive termination of this Agreement.
3. If any provision of this Agreement is held to be unenforceable
for any reason, such provision shall be reformed only to the extent necessary to
effect the original intentions of the parties, and the remainder of this Agreement
shall remain in full force and effect.
I have read and understood the Terms and Conditions for service provided by CNG
Internet, and agree to abide by them.
